The Former Managing Director Kano Agricultural Supply Company (KASCO), Bala Muhammad-Inuwa, has begged a Kano State High Court Judge, Justice Hafsat Yahaya-Sani, to recuse her self from an alleged N4 billion fraud suit against him.
Muhammad-Inuwa made the appeal in a motion for recusal, through his lawyer, Prof.Nasir Adamu-Aliyu, SAN, who expressed concerns about receiving fair treatment during the proceedings, stating that he believes he will not obtain justice in her court.
It will be recalled that Muhammad-Inuwa alongside his son, Bala Inuwa, were arraigned by the Kano State Public Complaints and Anti-Corruption Commission on alleged N4 billion fraud.
The prayers, as contained in his motion are: the case be reassigned to another judge at the Kano State High Court for a fair hearing and determination on its merits.
The defense counsel, Adamu-Aliyu, said the application was made based on several grounds, including the court’s dismissal of their notice of preliminary objection challenging the jurisdiction of the court.
“The judge’s refusal to grant leave for appeal for 14 days period stipulated by law.
“The judge had revoked the bail previously granted by another judge, Justice Usman Naabba, resulting in the defendants being remanded in a correctional center for 30 days.
“This actions indicated a potential bias and a departure from providing impartial justice” Adamu-Aliyu said
He said that the presiding judge has demonstrated personal interest in the case, suggesting a likelihood of bias.
“she should recuse herself from further involvement in the proceedings to ensure the principles of justice are upheld” Adamu-Aliyu said
