Osun LGA Funds: Court fixes sept. 29 for jurisdiction hearing ‎

The Federal High Court in Abuja will hear Osun state’s challenge to its jurisdiction on September 29 regarding the suit over withheld Local Government funds.

‎Osun state insists the case belongs in Osogbo since the court’s vacation ended on September 16, urging the matter to be transferred there for proper hearing.

‎This motion argues that the permission granted for hearing during vacation in Abuja is now invalid.

‎Musibau Adetunbi, counsel for the state government, also disputes the authenticity of a letter assigning the case to Justice Emeka Nwite in Abuja, beyond vacation. He noted the particular letter was signed by an unofficial office assistant—a sign of questionable legitimacy. He urged the court to first validate this letter before moving forward.

‎On the other side, counsel for the Central Bank of Nigeria and the Accountant General accused Osun state of using delaying tactics, stressing urgency, as the tenures of the APC local government officials end on October 22.

‎After hearing submissions, Justice Nwite set September 29 to decide on the jurisdiction issue before addressing other matters.

‎Earlier, the court struck out the Attorney General of the Federation from the suit due to a pending case against him in the Supreme Court.

‎Osun’s suit seeks to stop the CBN from operating accounts for APC-elected local government chairmen, who the Osun state government says were removed by previous court judgments. The state also wants to prevent disbursement of funds to these sacked officials.
